1 The service provider is Jadwiga Stępień, Jarosławki 13a. 72-130 Maszewo, NIP 6281267659,
REGON: 272710185.
(2) A customer is an individual who uploads and makes available to the Service Provider content in the form of a photo or video recording.
3 A user is an individual visiting the https://lowiskojaroslawki.pl website.
4 Within the scope of the maintained Service https://lowiskojaroslawki.plUsługodawca it enables the Service Recipients to send content which are photos or videos of fishing in the Jarosławki fishery. The Service Provider is not a content provider.
(5) Submitted photos and videos are subject to verification by the Service Provider. The Service Provider does not modify the uploaded photos and videos. The Service Provider is not obliged to publish the uploaded photos or videos.
(6) The content referred to in Section 4 of these Terms and Conditions is publicly available to all Users visiting the Website, i.e. publicly distributed.
(7) By uploading a photo or video, the Client grants the Service Provider, free of charge, a non-exclusive licence, unlimited in time and territory, to use the content uploaded by the Client on the Site in the following fields of exploitation: dissemination of photos or videos by making them available to the public in such a way that everyone can access them from a place and at a time individually chosen by them.
(8) Within the framework of the licence referred to in section 7 of these Terms and Conditions, the author agrees to use the opinions in any part, to use the work or any part thereof to promote and advertise the Service Provider's website on the Internet, in particular: on Meta (Facebook), Instagram and TikTok.
(9) By uploading and sharing a video or photo, the Client declares that it does not infringe the copyright of third parties. If the statement is untrue, the Service Recipient shall be liable to third parties for infringement of their rights.
10. it is forbidden to transmit illegal content that does not comply with these Terms and Conditions, in particular:
10.1 content of an advertising and/or promotional nature
10.2 content that violates the personal rights of third parties
10.3 content infringing copyright and related rights
10.4 vulgar content or terms generally regarded as offensive
10.5 threatening content directed at third parties
10.6 content that violates good morals, the law, social norms or customs
10.7 website addresses or links to other websites,
10.8 content containing personal or contact details of third parties
10.9 content inciting to violence and/or other dangerous behaviour
10.10 content that is false, defamatory or constitutes an act of unfair competition
10.11 obscene and pornographic content or incitement to hatred, racism, xenophobia and conflicts between nations.
11 Each User of the Website has the possibility to report illegal content that is not in accordance with these Regulations by means of an e-mail sent to the Service Provider's address rezerwacje@lowiskojaroslawki.pl. The notification should, if possible, contain data enabling the Service Provider to verify the notification, an explanation of the reasons why it considers the content to be illegal or inconsistent with these Regulations, contact details. The Service Provider shall notify the User of the result of its decision on the notification, its content and justification within 14 days from the acceptance of the notification. If the contact details of the reporting User are not provided, the Service Provider will not be able to contact the User in order to notify him/her of the receipt of the report and the result of the decision on the report.
(12) Clients and Users have the right to appeal against the decision referred to in section 11 of these Regulations. The appeal with justification may be submitted via e-mail rezerwacje@lowiskojaroslawki.pl within 14 days of receipt of the Service Provider's decision. The Service Provider shall communicate the decision with justification on the appeal to the parties concerned within 14 days of the delivery of the appeal.
(13) In the event that the Service Provider becomes aware of any information giving rise to a suspicion that a criminal offence endangering the life or safety of a person or persons has been, is being or may be committed, the Service Provider shall immediately inform the competent law enforcement or judicial authorities of its suspicion and provide all available information on the subject.
14 The administrator of the personal data provided during the use of the Newsletter service is the Service Provider. The purposes and scope of data processing, the entities to which the data will be transferred, as well as the rights of the data subjects are described in the Privacy Policy.
(15) In matters not covered by these Terms and Conditions, the provisions of the Civil Code and the Act on the provision of electronic services of 18 July 2002 shall apply.
(16) The regulations are effective from 19.04.2024.
